[ARCHIVED] Frederick Police Arrest Two Men After Guns Located (SCU)

The Frederick Police Department’s Street Crimes Unit has arrested one adult male and a juvenile male after locating two handguns.

On 01/20/2017, officers of the Frederick Police Department’s Street Crimes Unit observed a vehicle commit a traffic violation in the area of N. East Street and E. Patrick Street, in Frederick City. A traffic stop was conducted in the 800 block of E. Patrick Street. When the officer made contact with the occupants, he noticed the rear passenger to be a person the SCU was previously surveilling earlier in the evening due to his suspicious behavior. 

During the traffic stop, the rear passenger continued acting in a suspicious and nervous manner. As a result, an officer removed the rear passenger, who was later identified as, Xavier Alton Hoy. Once Hoy was removed from the vehicle, officers located a loaded .380 semi-automatic handgun.  The handgun was located in the immediate vicinity of Hoy’s seating position. As a result, Hoy was placed under arrest and the remaining vehicle occupants were removed and the vehicle was subsequently searched. It was later found Hoy is a convicted felon and unable to possess firearms.  

During the search of the vehicle, officers located another handgun underneath the front passenger seat, which is where Neal Stevenson Hall was seated. Hall was immediately placed under arrest. The second handgun was a loaded 9 mm semi-automatic pistol. The pistol was loaded with a 22 round magazine. A check of this handgun revealed it was reported stolen in Raleigh, NC. Hall was determined to be a juvenile but was charged as an adult based on the crime.

No additional contraband was located within the vehicle. The driver was released from the scene without charges.

Hoy and Hall were transported to the FCADC for an appearance before a District Court Commissioner.

(1) Count of wear/carry/knowingly transport a handgun in a vehicle
(1)  Count of wear/carry/transport a handgun about their person
(1) Count of possessing a regulated firearm under the age of 21 (Two associated charges)
(1)  Count of possessing ammunition
(1)  Count of possession of a stolen firearm
(1)  Count of possession of a detachable magazine with a capacity of more than 10 rounds
